According to Virginia Mercury, the petition was lodged by Stephen Edward Schwartz, Judith Anne Parker, and Juliet McGee Schweiter. They argue that Carroll is improperly registered to vote in House District 64. The article states that Carroll changed her registration on February 5, 2025, to an address on Pinkerton Court in District 64. However, the petitioners claim she still lives at her longtime home on Bismark Drive in District 23. The filing requests the court cancel Carroll’s voter registration at the Pinkerton address, decertify her candidacy for District 64, and remove her name from the ballot.
Virginia Mercury also published the petition PDF detailing that Carroll’s Bismark Drive property has been her residence since April 2018 and remains where she is allegedly physically present consistently. The filing includes evidence such as her primary vehicle being regularly parked overnight at Bismark Drive and her mail and utilities continuing there. Petitioners argue these indicators undermine Carroll’s claimed change of domicile under Virginia’s legal standards for voting and candidacy.
Fox News confirms that the lawsuit cites Virginia Code § 24.2-431, which allows voters to contest another’s voter registration in their county. Fox also notes the significance of this challenge, suggesting it could affect control of the Virginia House since the District 64 race is considered competitive. It reports that plaintiffs allege Carroll still resides near US-1 road in District 23 while filing candidacy as if she lived in District 64, seven miles away.
